Bail and Bail Bond Agent

Bail is the amount of money required by the court in order for it to grant temporary release to a defendant awaiting trial. The money will be used by the court in order to make sure that the defendant appears at all of his court dates after he is released. If he complies, the money will be refunded at the end of the trial minus a 3% administrative fee. If he fails to show up, the bail is forfeited and a warrant is issued for his arrest. If bail cannot be paid, the defendant stays in jail until he is released or the case is dismissed.

Bail can be paid using various forms of money. Because the court requires that payment be made in the exact amount, you are allowed to use different modes of payment in one transaction. These are:

  • US Cash
  • Credit Card (with an 8% processing fee)
  • Debit Card
  • Cashier’s Check (should not be greater than the bail amount)
  • Money order from a bank or Western Union (each order must not be greater than $1000)

A pretrial inmate can also opt to use a bond agent to help him post bail. A bond agent requires the payment of a bond fee which is non-refundable. Because the New York State Insurance Department regulates this industry, you can easily calculate the fees based on the tiered system.
For a bond of $200 or less, the fee is $10.
For a bond of $3000 or less, the fee is 10% of the bail amount.
For a bond of $3001 to $10000, the fee is 10% of the first $3000, 8% of the remaining amount.
For a bond more than $10000, the fee is 10% of the first $3000, 8% of the amount between $3000-$10000, and 6% of the remaining amount.
    Here’s a sample calculation:
    A $15000 bond has a bond fee equal to ($3000 x 10%) + ($7000 x 8%) + ($5000 x 6%) which is $1160.
