Bail and Bondsman
A person charged with a crime does not always have to stay incarcerated while waiting for his trial to begin. He can secure his release by posting bail. Bail involves making a promise to the court that the defendant will appear at all his court dates. It may also involve the promise of money or property to be paid to the court if the defendant fails to appear at his trial.
If a defendant does not have the money or property required by the court to post bail, he can get a bondsman to act as a surety – to claim before the court that he will make the payment on behalf of the defendant. A bondsman typically charges 10% of the bail amount as his fee and this is not refundable.
In Kentucky, running a commercial bail bond business is considered illegal. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). A bondsman from a different state can only arrest a fugitive who has fled to Kentucky if he first gets a warrant. Ky. Rev. Stat. § 440.270.
