The law orders that sex offenders submit their information to the County Sheriff so that it may be recorded in the state and national sex offender registries. Bail and Bondsman

Bail is the written authorization of the court that allows an inmate awaiting trial to be released from custody or jail with the promise that the inmate will show up for all his required court appearances. The court may also require a pledge of money or property before the inmate can secure his release. If the defendant does not keep his promise, the money or property is lost.

Some inmates cannot pay the bail amount on their own. A bonds agent can be hired to post bail and act as a surety. This means that he will guarantee payment of the bail amount to the court if the defendant does not show up as promised. The bondsman’s fee is usually 10% of the bail amount and non-refundable.

The state of Kentucky has banned commercial bail bonding. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). Fugitives who have skipped bail and fled to Kentucky can only be arrested by bonds agents from another state if they acquire a warrant. Ky. Rev. Stat. § 440.270.
