Bail and Bondsman

The court requires a defendant to put down money as a form of collateral in exchange for getting released prior to the start of the trial. This money, called bail, is used to guarantee the defendant’s compliance with his court obligations. If he fails to meet the conditions of his release (i.e. not showing up in court), then the money is forfeited and the defendant is labeled a fugitive.

A defendant can still be able to get out on bail even if he cannot afford to pay the entire amount set by the court. This can be done with the help of a bondsman. For 12% of the bail amount, a bondsman can post bail on behalf of the defendant. In case the defendant skips bail, it will be the bondsman’s responsibility to pay the court what is owed.
