Bail and Bondsman

A person charged with a crime can stay out of jail pending trial if he is able to post bail. Bail is the amount of money set by the court in exchange for granting a pretrial inmate’s release. This money is used to make sure that the defendant shows up in court as promised. If he fails to do this, the bail is forfeited.

If a defendant does not have the financial resources to post bail on his own, he can secure the services of a bondsman. A bondsman will act as a surety – signing a bond to get the defendant released and promising to pay the entire amount listed on the bond if the defendant fails to appear in court. For this kind of service, the fee is usually 12% of the bail amount and it cannot be refunded.
